Obama Administration Won’t Change Breast Cancer Screening Policy

Are mammograms unnecessary for women until they turn 50? Have the politics on health care reform gotten in the way of doing what’s best for the prevention of breast cancer? Will this effect insurance coverage for the procedure?

Addressing one of the questions, The Obama Administration announced government insurance programs would continue to cover routine mammograms for women starting at age 40, reports today’s New York Times.

This was in response to the Preventative Services Task Force recommendations that women not start routine mammograms until they are aged 50, instead of 40. The research showed that benefits gained starting at aged 40 were small. The downside of earlier screenings was that they lead to excess biopsies, unnecessary anxiety as well as discovery and treatment of tumors that would not cause problems if left alone.

The Physician Data Query Group, a physician group that evaluates new research on cancer research for the National Cancer Institute, recommended that the task force’s evidence be added to all information passed onto doctors and the public.
Members of the group were frustrated that mammogram screenings had become the center of political debate.

One member of the Physician Date Query, Dr. Russell Harris, a former member of the Preventative Services Task Force, explained that when the old guidelines were released by the task force in 2002 there had been less research on the topic.

According to Vitals.com, Dr. Russell received his medical degree at John Hopkins University and completed his specialty training at Duke University.

The Democrats believe the timing of the study’s release was just another opportunity for Republicans to raise doubts about the health care plan now being prepared for a vote in the Senate. Kathleen Sebelius, the Secretary of Health and Human services, assured the country that their policies remain unchanged on this issue. She pointed out that the task force is an outside independent panel of doctors and scientists who make recommendations but don’t set federal policy.

Dr. Thomas Frieden of CDC Announces Americans Are Still Smoking

Although anti-smoking campaigns worked well in the past decades lowering rates by 4% since 1998 alone, these last five years showed no progress in stopping Americans from smoking. In fact, the rate has increased from 2007 to 2008, according to U.S. Centers for Disease Control and Prevention.

Experts believe the decline is affected by the “cutbacks in funding for state tobacco-control programs, which had proven successful before.”

“Tobacco is the leading cause of preventable death in the U.S., and we know what to do,” said Dr. Thomas Frieden, the CDC director. “We want to provide support to states and localities to implement proven programs, and if we do that, we can save literally millions of lives in the decades to come.”

According to Vitals.com, Dr. Thomas Frieden is also the Commisioner of Health and Mental Hygiene of NYC.  He completed his medical degree at Columbia University and residency for infectious disease at Yale University School of Medicine.

Dr. Thomas Frieden believes that creating smok-free environment, like restaurants and office buildings has contributed to the overall decrease in the past decade.  It will continue to be enforced in more and more states, which hopefully impact the increasing rates of smokers.

In addition, more places are becoming smoke-free, he said. “Going smoke-free not only protects the health of nonsmokers but also encourages smokers to quit,” Freiden said.

Dr. Regina Benjamin Confirmed As Surgeon General by US Senate

(RTTNews) -  Dr. Regina Benjamin received Senate confirmation late Thursday to serve as U.S. surgeon general, making her only the third African-American to hold the position.

She was nominated for the position by President Barack Obama back on July 13 and received unanimous approval during the confirmation vote Thursday night.

At a press conference in July when her nomination was announced, Benjamin said she would “be a voice in the movement to improve our nation’s health care, and our nation’s health, for the future.”


Commenting on Benjamin’s confirmation, Health and Human Services Secretary Kathleen Sebelius said, “Dr. Benjamin will quickly become America’s doctor as our next Surgeon General. Her deep knowledge and strong medical skills, her commitment to her patients, and her ability to inspire the people she interacts with every day will serve her well as Surgeon General.”

Sebelius added, “She will be an integral part of our H1N1 response effort, and America can expect to see her very soon communicating important information about how to stay healthy and safe this flu season.”

Benjamin’s confirmation took as long as it did because Senate Republicans had blocked her confirmation after the Obama administration barred those insurance companies that take part in the Medicare program from arguing to seniors that Obama’s proposed healthcare reform could mean benefit cuts.

Before receiving the nomination, Benjamin had served as a board member of the American Medical Association. She was the only African-American to serve on the board.

She had also served as chairwoman of the AMA’s Council on Ethical and Judicial Affairs.

President Obama’s Healthcare Address Greeted By Hoots, Hollers and Hisses

After a summer of vocal opposition to his health plan, President Obama displayed his strength as a political leader in a 47 minute speech presenting a case for overhauling the healthcare system. It was live political theater at its best, including the continuous sound of cheers and applause, a letter from Ted Kennedy after his death and even an unruly heckler who shouted “you lie,” impolitely putting himself front stage center

Republicans felt the speech came up short and was out of step with the changes Americans wanted. Representative Charles Boustany Jr. of Louisiana agreed that health care needed an overhaul, but felt the president needed to come up with a fresh plan.

“It is clear the American people want health care reform. But they want their elected leaders to get it right. Most Americans wanted to hear the president…. tell Congress that it’s time to start over on a common-sense bipartisan plan focused on lowering the cost of health care while improving quality.”

According to Vitals.com, Dr. Boustany received his medical degree at Louisiana State University and completed his residency in Thoracic Surgery at Strong Memorial Hospital in Rochester.

Obama said the changes would cost about $900 billion over the decade that is more likely to exceed $1 trillion.

Some of the highlights of the speech:

* Insurance policies couldn’t be canceled because of sickness or denied for pre-existing conditions. For those who can’t get insurance, because of a pre-existing condition, the government would provide low cost coverage to protect them against ruin.

* Government subsidies would be available to make premiums affordable. Every American would be required to carry coverage, “the same way drivers carry auto insurance.”

* A fee, or tax, on health insurance companies would be imposed for their most expensive policies.

* A provision for the federal government to sell insurance in competition with private industry.

* A mechanism to control and reduce the growth of Medicare.

* A new initiative to create pilot projects to help curb medical malpractice suits, a cause important to Republicans and physicians.

A CNN poll interviewed a random sample of 427 adults who watched the speech. 18% identified themselves as Republican, 45% as Democrats and 37% as Independents.

When asked about their overall reaction to the speech 56% were very positive.  70% felt that Obama’s policies would move the country in the right direction. When asked how they felt about the President’s plan to reform health care, 67% were in favor of his plan. But when asked how likely it was that Congress would pass the proposals, only 20% felt is was very likely.

This general feeling was reinforced as Republicans arrived ready to fight. The president was heckled when he dismissed the notion of death panels that denied coverage to the elderly. “It is a lie, plain and simple,” Obama stated.

Their raucous disapproval spilled over when Senator Ben Cardin shouted, “You lie” when Obama asserted that nothing in his plan would provide coverage to illegal immigrants. The senator proved to be wrong, the bill would require illegal immigrants to buy coverage.

Facing his tough bipartisan audience, President Obama drew much needed laughter as he stated:

“There remain some significant details to be ironed out.”

Dr. Richard Rafal Giving Lawyers a Taste of Their own Medicine - Instituting Socialized Legal Care

President Obama is preparing to address the nation on Wednesday, clarifying healthcare reform yet again. An issue that looms large for physicians is the exorbitant cost of malpractice, which has lead to the expensive practice of ordering unnecessary tests for their patients.

The Wall Street Journal has estimated that malpractice litigation costs have crept up to 30 billion dollars a year. The Massachusetts Medical Society and UConn Health Center did a study of over 900 physicians in Massachusetts and found that 83 percent reported practicing defensive medicine and that 18-28 percent of tests was ordered to protect them from malpractice. The cost incurred in the state of Massachusetts was estimated at 1.4 billion dollars a year.

The response from litigators is that if doctors would make fewer errors then fewer cases would end up in court.

This type of rhetoric from the legal profession has gotten under the skin of physicians everywhere. Dr. Richard Rafal has come up with his own solution and feels it’s time to give lawyers a taste of their own medicine. According to Vitals.com, Dr. Rafal received his medical degree at Drexel University and completed his residencies in radiology at Lenox Hill Hospital and Cornell.

Here is an abbreviated version of his suggestions, printed in the Wall Street Journal, for a proposed bill that would dismantle the existing framework of law practice and institute socialized legal care:

Contingency fees will be discouraged, and eventually outlawed, over a five-year period. This will put legal rewards back into the pockets of the deserving—the public and the aggrieved parties.
Legal “DRGs.” Each potential legal situation will be assigned a relative value, and charges limited to this amount. Government schedules of flat fees for each service, analogous to medicine’s Diagnosis Related Groups (DRGs), will be issued. For example, any divorce will have a set fee of, say, $1,000, regardless of its simplicity or complexity. This will eliminate shady hourly billing.
Legal “death panels.” Over 75? You will not be entitled to legal care for any matter. Why waste money on those who are only going to die soon? We can decrease utilization, save money and unclog the courts simultaneously. Grandma, you’re on your own.
Ration legal care. One may need to wait months to consult an attorney. Possibly one may not get representation before court dates or deadlines. But that’ s tough: What do you want for “free?”
Physician controlled legal review. This is potentially the most exciting reform, with doctors leading committees for determining the necessity of all legal procedures and the fairness of attorney fees. What a wonderful way for doctors to get even with the sharks attempting to eviscerate the practice of medicine.
Discourage/eliminate specialization. Legal specialists with extra training and experience charge more money, contributing to increased costs of legal care, making it unaffordable for many.
Electronic legal records. We should enter the digital age and computerize and centralize legal records nationwide. Anyone with Internet access will be able to search the database.
Ban legal advertisements. Catchy phone numbers such as 1-800-LAWYERS would be seized by the government and re-purposed for reporting unscrupulous attorneys.
Collect data about the supply of and demand for attorneys. Create a commission to study the diversity and geographic distribution of attorneys, with power to stipulate and enforce corrective actions to right imbalances. The more bureaucracy the better. One can never have too many eyes watching these sleazy sneaks.
Lawyer Reduction Act (H.R. -3200). A self-explanatory bill that not only decreases the number of law students, but also arbitrarily removes 3,200 attorneys from practice each year. Textbook addition by subtraction.
